If discrepancy exists between the English version and the Chinese version, the English version shall prevail.
Applicant must be 18 years old or above.
The policy must commence within 30 days from the date of application.

I/WE,HEREBY DECLARE AND AGREE THAT:

The answers to all the above questions including all information and particulars given herein are accurate, true and complete and are given to the best of my/our knowledge and belief. I/We have not withheld any material information and accept that this application and declaration shall form the basis of the contract between Blue Cross (Asia-Pacific) Insurance Limited ("the Company") and me/us. I/We hereby acknowledge that failure to supply true and accurate answers to this application or inform the Company of all material information about my/our application may render the Company unable to accept or process this application or the insurance policy void.

The insurance coverage applied for shall only take effect when this application has been accepted by and the first premium has been paid to the Company.

To the best of my/our knowledge, the insured premises have never suffered any fire damage or other loss in the past two years.

I/We have never had any new application/renewal declined, nor have special terms and conditions been imposed on such application or renewal for household insurance.

Personal Information Collection Statement

I/We understand and agree that any personal information collected or held by the Company (whether contained herein or otherwise obtained) may be used, stored, disclosed or transferred (within or outside of Hong Kong) to any individuals/organizations associated with the Company or any third party the Company may consider necessary including any other company carrying on insurance or reinsurance related business, any intermediary, claims investigator, medical facilities, other service providers relevant to insurance business, professional advisor, government authority or industry association/federation for the purposes of: (1) processing of this application/request and provision of insurance or financial related product or service or any addition, alteration, variations, cancellation or renewal or reinstatement of them; (2) any scope of insurance coverage, claim processing or investigation or analysis and data matching; (3) promotion of financial products or services by the Company and its affiliated companies; (4) communicating with me/us/the insured or any relevant organization/person as the Company considers appropriate; and (5) meeting any disclosure requirements imposed by law or court orders or pursuant to guidelines issued by regulatory or other relevant authorities. I/We have the right to obtain access to and to request correction of any personal information concerning myself/ourselves held by the Company. I/We understand that if I/we do not want my/our personal information to be used for purpose (3) above, I/we may notify the Company at any time. Such request(s) or notice(s) can be made in writing to the Company's Corporate Data Protection Officer at 29th Floor, BEA Tower, Millennium City 5, 418 Kwun Tong Road, Kwun Tong, Kowloon, Hong Kong.

The following Terms and Conditions - Online HomeSafe Protection Insurance Application (referred as the "HSPI" Application thereafter), without limitation, carries out the Customer's obligations when making HSPI Application. Customer's use of the Company's HSPI Application websites is additionally subject to the following other Terms and Conditions, namely:

(all the above mentioned Terms and Conditions are collectively referred as "All Terms and Conditions" thereafter). 

Terms and Conditions - Use of the websites

1. General Information

(a) The following Terms and Conditions - Use of the websites, is for you, the Users (referred as "the User" thereafter) to agree to be bounded by when accessing and/or using the websites, e.g. www.insurance.net.hk and affiliated sites, e.g. www.travel.com.hk, www.insurance.com.hk, (all websites and sub-websites concerned are collectively referred to as "the websites") that contain, without limitation, materials, contents, data, insurance products and services shopping facility and information which may be offered from time to time by Auspharm Trading (H.K.) Limited (referred as "the Company" thereafter). 

(b) User's access and/or use of the Company's websites is expressly conditioned on the User's acceptance of All Terms and Conditions contained in this Agreement. By accessing and/or using the websites of the Company, the User signifies the User's assent to All Terms and Conditions. If the User does not agree with any of All Terms and Conditions, the User must not access and/or use the websites of the Company. 

(c) Words and terms used in All Terms and Conditions importing the singular include the plural and vice versa and words importing one gender include all genders.

(d) The Company may change All Terms and Conditions from time to time without prior notification to the User. By continuing accessing and/or using the websites, the User implies agreement to the latest All Terms and Conditions. Continued access and/or use of the websites after such changes shall constitute the User's consent to such changes.

(e) The Company may, at any time and at its sole discretion and without cause or notice, terminate or restrict any User's access to and/or use of the Company's websites or refuse to give effect to any purchase, insurance transactions requested and/or initiated by any User without being required to give any reasons or advance notice.

(f) If the User has any questions about All Terms and Conditions, please contact the Company for clarification.

2. Use of the websites

(a) The User shall access and/or use the websites only for the purposes of discovering insurance products and services; and making application for purchases of insurance products/services from the Company, offered from time to time by the Company. No part of the websites nor any of its materials, contents, data and information shall be exploited by the User commercially or used for any speculative, fraudulent mischievous, unlawful or prohibited purpose whatsoever, including but not limited to re-sale of goods, products and information as provided by the Company. 

3. Accuracy of Information

(a) The Company does not endorse or recommend any particular insurance service provider, and/or products and services. All  information and listings are subject to amendment at any time without notice. The Company publishes such information in good faith. As User you acknowledge and accept that the Company cannot and has not completely checked the accuracy of all information provided by insurance service providers such as insurance companies. The User should make her/his own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the websites.

4. Termination

(a) The Company reserves the right at any time at its sole and absolute discretion and without notice to revoke the right of any User to access and/or use the websites. The User agrees that the Company, in its sole discretion, may terminate the access and/or use of the websites, cancel the User's purchases of insurance products/services from the Company, and remove and discard any materials, contents, information, online transaction facility within the websites for any reason, including, without limitation, for lack of access and/or use or if the Company believes that the User has violated or acted inconsistently with All Terms and Conditions of this Agreement. The Company may also in its sole discretion and at any time discontinue providing the websites, or any part thereof, with or without notice. 

(b) The User agrees that any termination of the User's access to and/or use of the websites under any of All Terms and Conditions of this Agreement may be effected without prior notice, and User acknowledges and agrees that the Company may immediately bar any further access to any parts and/or use of the websites. Further, the User agrees that the Company shall not be liable to the User or any third-party for any termination of the User's access and/or use of the websites and the consequences thereafter.

5. Exclusion of Warranty

(a) The access, content, data, facility and other features of the websites (referred to as the "Features" thereafter) are provided by the Company for the User's personal viewing and convenience. No warranty is made, whether express or implied, with respect to the accuracy, reliability, merchantability, fitness for a particular purpose, title or non-infringement of the Features and the Company does not warrant that the websites, the server, the software, the computer equipment or other facilities used will be free from viruses or harmful components or that the Features will operate in an uninterrupted or error-free manner. The Company disclaims any and all implied warranties relating to the provision of the Features.

6. Disclaimers and Limitation of Liability

(a) The Company and its officers, directors, employees and agents, shall in no event be liable for any damages to or viruses that may infect the User's computer equipment or other property on account of the User's access and/or use of the websites or the User's downloading of any materials, contents, data, text, images, video or audio from the websites.

(b) In no event shall the Company and its officers, directors, employees and agents be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including but not limited to loss of profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with (1) the use of or reliance on the websites or any of its contents, (2) failure or delay to update the data or presentation of inaccurate or corrupt data at the websites, (3) any access and/or use of the websites or Features found herein, (4) any failure or delay (including, but not limited to the access and/or use of or inability to access and/or use the websites, any component of the websites), or (5) the performance or non-performance by the Company and its officers, directors, employees and agents even if such party has been advised of the possibility of damages to such parties or any other party.

7. Indemnification

(a) The User shall defend and indemnify the Company and its officers, directors, employees and agents from and against any damages, claims, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on the User's behalf or by third parties as a result of the User's access and/or use of the websites. 

8. Governing Laws

(a) This Agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administration Region (HKSAR), without giving effect to any principles of conflicts of law. Those Users who choose to access and/or use the websites from other geographies and locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Except for equitable relief sought by the Company, which may be sought in any court of competent jurisdiction, the User consents to the exclusive jurisdiction of the Hong Kong Special Administrative Region courts. 

9. Ownership, Copyright and Trademarks

(a) The websites is designed and created exclusively by the Company. The contents and the online insurance product or transaction facility provided and offered from time to time on the websites are owned by the Company. Unauthorized use is strictly prohibited. All titles, trademarks, trade names, brands, logos, ownership rights and intellectual property rights, including copyright, rest with the Company.

(b) The User shall not at any time and/or by any means copy, reproduce, distribute, sell, transfer, republish, store, archive or use other than as intended at the websites with or without alteration or modification, any of the works, designs, contents, trademarks, trade names, brands and logos without the prior written permission of the Company.

10. Links to Third Party websites

(a) The websites may contain hyperlinks to their third party websites for convenience only. These third party websites are not maintained by the Company and the Company is not responsible, nor does it control the contents and information of such third party websites. The aforesaid hyperlinks do not imply any association with or endorsement by the Company of the publishers of the third party websites or their products and/or services offered.

11. Notes, Notices and Disclaimers

(a) Notes, notices and disclaimers are posted throughout the websites so as to ensure that the User is duly notified and reminded of the User's obligations upon using the websites or making insurance transactions at the relevant time. Unless otherwise expressly stated, in accepting All Terms and Conditions, the User is also deemed to have been notified and to have accepted and consented to the terms and conditions stipulated in the said notes, notices and disclaimers.



Terms and Conditions - Online HomeSafe Protection Insurance Application


1. General Information

(a) Online HomeSafe Protection Insurance Application is an Internet-enabled platform (referred as the "General Insurance websites" thereafter) provided by Auspharm Trading (H.K.) Limited (referred as the "Company" thereafter) through the Company's websites to enable you, the Customer (referred as the "Customer" thereafter), to apply and purchase HSPI timely and conveniently no matter whether you are at home or on a journey away from Hong Kong. The complete application and purchasing procedures should only take a couple of minutes. 

When you make an application for your HSPI on the Company's websites, you will be offered this innovative personalized service by the Company, as an insurance agent for the Insurance Companies, their underwriters, and their service vendor/provider on the Company's websites. You need to fill in and complete the necessary details truthfully and accurately on the HSPI application form. If you pay the full insurance premium online using your valid credit card, your HSPI Application should be automatically approved by the Insurance Companies, their underwriters, and their service vendor/provider concerned. Instantly, you will obtain your HSPI policy document on your computing equipment.

(b) The Company acts only as an insurance agent for the concerned Insurance Companies, their underwriters, and their service vendor/provider for their HSPI product that are available for application and purchase by the Customers. The Company makes no warranty of any kind regarding the HSPI products and the HSPI Application. These General Insurance websites and or any materials and contents provided on the websites, all of which are provided on as "As Is" basis. The Company do not warrant the accuracy, completeness, currency or reliability of any of the materials, contents or data provided through the General Insurance websites or found on this HSPI Application. The Company expressly disclaim all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade. 

(c) The Customer acknowledges that some of the materials and contents accessible through these General Insurance websites are provided by third parties and the Company is not responsible for those third parties or the goods or services they offer. Customer's use of this HSPI Application and/or the Company's General Insurance websites is expressly conditioned on the Customer's acceptance of All Terms and Conditions. By using the HSPI Application of the Company, the Customer signifies the Customer's assent to and is bounded by All Terms and Conditions. If the Customer does not agree with any of All Terms and Conditions, the Customer must not use the HSPI Application of the Company and/or the Company's General Insurance websites.

(d) The Customer is financially responsible for all uses of the HSPI Application and/or the General Insurance websites provided by the Company regardless whether the Customer is actually using them by herself/himself, or by any third parties including but not limited to minor or children, with or without the knowledge of the Customer at the time of using the HSPI Application and/or the General Insurance websites. 

(e) Insurance Companies, their underwriters, and their service vendor/provider impose different terms and conditions on the sale of specific general insurance products and related insurance products featured on the websites. The Customer should carefully read the information on their (that is, Insurance Companies, their underwriters, and their service vendor/provider) brochures, coverage, schedule of benefits, terms and conditions, as well as exclusions, important rules, and claim procedures specific to the general insurance products and related insurance products before making and finalizing the HSPI Application.

(f) Words used in All Terms and Conditions importing the singular include the plural and vice versa and words importing one gender include all genders.

(g) The Company may change All Terms and Conditions from time to time without prior notification to the Customer. By continuing using this HSPI Application and/or the General Insurance websites, the Customer implies agreement to the latest All Terms and Conditions. Customer's continued use of the HSPI Application and/or the General Insurance websites after such changes shall constitute the Customer's consent to such changes.

(h) The Company may, at any time and at its sole discretion and without cause or notice, terminate or restrict any Customer's access to this HSPI Application or the Company's General Insurance websites or refuse to give effect to any application or purchase of general insurance requested by any Customer without being required to give any reasons or advance notice.

(i) If the Customer has any questions about All Terms and Conditions, please contact the Company for clarification.

2. General Insurance Products 

(a) The general insurance products available on the Company's General Insurance websites include, but not limited to general insurance products and insurance related products offered by the Insurance Companies, their underwriters, and their service vendor/provider approved by the Company. For examples, HomeSafe Protection Insurance, Domestic Helper Plus Insurance and Travel Insurance by Blue Cross (Asia-Pacific) Insurance Limited. These Insurance Companies, underwriters, service vendor/provider are owned and operated independently, and therefore, the Company cannot ensure that the Customer will be satisfied with nor shall the Company be liable in any way for any loss or damages by the Customer of their insurance policies, products, services or business practices.

(b) All the materials and information found and/or shown on this HSPI Application and/or General Insurance websites, including but not limited to the brochures, coverage, schedule of benefits, terms and conditions, as well as exclusions, important rules, and claim procedures specific to the general insurance products and related insurance products are provided to the Customer for reference purpose only. All general insurance products offered to the Customer for application and/or sales are subject to availability, acceptance, confirmation, fulfillment, denial, cancellation and/or postponement of such general insurance products solely at the discretion of the Insurance Companies, their underwriters, or their service vendors and providers concerned. 

3. Application of HomeSafe Protection Insurance (HSPI)

(a) All HSPI must be applied for and approved before the commencement of the period proposed for the premises for insurance coverages to take effect.

(b) The premises of the Customers (insurance applicants) to be insured must be proper residential accommodation in Hong Kong Special Administrative Region (HKSAR or referred as "Hong Kong" thereafter). The premises to be insured must not be subjected to or connected with any fire or other loss previously. The address of the Customer must be a valid residential address. Typical examples of invalid address are post office box address, email address, hotel address, etc. The country/territory of the Customers' and/or applicants' addresses must be Hong Kong.

(c) The Customer must be responsible for the truthfulness and accuracy of the information provided when applying a HSPI. The Company is not responsible for any untrue and inaccurate information provided by the Customer. The Customer must rectify any untrue and incorrect information of the HSPI Application and be liable to damages arising from the inability of rectification of such untrue and incorrect information. 

(d) In the event of HSPI Application and/or the General Insurance websites are not available due to whatever reasons such as the requested general insurance product does not have an online credit card payment option, or the insurance policy document cannot be issued by the Company online, the Customer should not proceed further. The Customer may choose to contact the Company by phone or by email or by fax to make further enquiries. 

4. Coverage and Benefits

(a) The various details and/or plans of the general insurance products, their coverage and respective benefits are solely responsible and independently provided by the Insurance Companies, their underwriters, and their service vendor/provider. These details and/or plans are generally available on our Company's General Insurance websites for the Customer's reference.

(b) In making an application for HSPI by the Customer through the Company's General Insurance websites, the Company merely provides an online platform on the Internet for the Customer to apply for general insurance and cannot be held responsible for coverage and benefits, premium, claims, misinformation or mishandling of general Insurance by the Insurance Companies, their underwriters, and their service vendor/provider concerned, and/or any other dissatisfaction or complaint of the Customer to the quality, terms and conditions, exclusions, etc. of the general insurance provided by the Insurance Companies, their underwriters, and their service vendor/provider concerned or otherwise howsoever. In the event of claims, disputes, misinformation or mishandling by the Insurance Companies, their underwriters, and their service vendor/provider, or any other dissatisfaction or complaint aforesaid, the Customer should take up the matter directly with the Insurance Companies, their underwriters, and their service vendor/provider concerned.

(c) The Company accordingly accepts no responsibility or liability for any misunderstanding or error, whatsoever and howsoever caused, in respect of any application made. The onus rests on the Customer to read and understand the brochure, coverage and benefits, premium, terms and conditions, exclusions and claims procedure in associated with the Insurance Companies, their underwriters, and their service vendor/provider concerned and ensure your application abides by these, to carefully check and correct any mistakes in the Customer's HSPI Application and in any confirmation and/or insurance policy document thereof received from the Insurance Companies, their underwriters, and their service vendor/provider concerned via the Company. 

5. Premium Prices and Currency

(a) The insurance premiums published on the Company's General Insurance websites are subject to change from time to time and without prior notice by the respective Insurance Companies, their underwriters, and their service vendor/provider. The HSPI application form constitutes a request only and the Company does not guarantee the premium amount until the HSPI Application has been confirmed by the Company and approved by the Insurance Companies, their underwriters, or their service vendor/provider concerned. Insurance product availability, premium and coverage and benefits for any general insurance products can change at any time by the Insurance Companies, their underwriters, or their service vendor/provider concerned. Any additional costs will be advised to you when the Customer's HSPI Application is confirmed. 

(b) The supported billing and payment currency for the premium of the HSPI is Hong Kong Dollars. The Company will bill the Customer in Hong Kong Dollars and the Customer will pay the Company with Hong Kong Dollars.

(c) The Company does not impose handling fees in the processing of HSPI Application made by the Customer except for insurance policy document delivery charge when requested by the Customer (please see Clause 7 (c) below).

6. Payment of Premium

(a) The amount of premium required for HSPI Application depends on a number of factors, including but not limited to, the specific type (plan) of general insurance product, the range of insurance coverage and benefits, the duration of coverage, the number of insured items, etc. The Company will advise the Customer of the required premium either interactively via the General Insurance websites or via phone/email/fax as appropriate after an HSPI Application is made.

(b) Payment of premium for HSPI Application may be made by online payment method only. The online payment method is by means of valid credit card through the payment gateway of Tiglion Travel Services Company Limited. The Customer must make payment IN FULL for the premium of the HSPI Application, including but not limited to the insurance applicant, and any other persons insured under the same HSPI Application. HSPI policy document will NOT be issued before full payment of premium is received by the Company. 

(c) The Company only accepts a valid credit card which belongs to the Customer who is the main insurance applicant of the HSPI Application. The reason for this is to protect our customers from any potential frauds associated with the purchasing of general insurance products on the Internet.

(d) If the Customer fails to make full payment, the HSPI Application will be automatically rejected, rescinded and cancelled.

7. HomeSafe Protection Insurance (HSPI) Policy Document Collection

(a) Only those general Insurance products that accept full payment of premium by means of a valid credit card online will have their insurance policy document to be instantly available to the Customer on his/her computer equipment after full payment of premium and approval of the HSPI Application by the Insurance Companies, their underwriters, and their service vendor/provider. The insurance policy document can be printed on the Customer's printing equipment or may simply be saved on the disk storage media of the Customer's computing equipment for subsequent retrieval or printing. However, the Company is not responsible for the Customer's failure of printing the Insurance policy document or the Customer's loss of the insurance policy document. 

(b) An electronic copy of the insurance policy document will also be maintained on the Company's websites. This electronic copy may be accessed by the Customer later. The retention period of this electronic copy of insurance document will be determined by the Company from time to time. When the retention period expires, the electronic copy of the insurance policy document will be deleted from the Company's websites without any prior notice given to the Customer. 

(c) For those general insurance products that do not accept payment of premium via credit card online, the physical insurance policy document will be made available to the Customer which should collect it at the Company's office in Hong Kong (after full payment of premium and approval of the General Insurance Application by the Insurance Companies, their underwriters, and their service vendor/provider). Alternatively, the Customer may request the Company to deliver the insurance policy document to a designated address at an extra administration and delivery charge. The Customer should call the Company and request for the appropriate delivery arrangement after making a general insurance application in a conventional trade practice.

(d) If the Customer chooses to request the Company to deliver the insurance policy document to a specified address, the Customer must be responsible to provide and verify the correctness of the address. The Company is not responsible for the correctness of the address for the insurance policy document delivery. Further, any delay, loss or damage that may occur during the delivery of the insurance policy document by the delivery service provider is at the sole risk of the Customer and it is not the responsibility of the Company. 

(e) The Company requires adequate lead time to arrange delivery of the insurance policy document to Customers who choose the option for the Company to forward to them the insurance policy document by post, express delivery or other specified modes of transportation or transmission. The Company will not assume any responsibility nor guarantee that the purchased insurance policy document will be able to be received by the Customers who choose not to collect their insurance policy document at the Company's office in Hong Kong. Therefore, it is pertinent that the Customers should allow ample lead time for making an offline or non-online insurance application. Further the Customers will assume full risk if they request the delivery of their purchased insurance policy document to their specified point of collection. 

8. Refund

(a) The Company will not make refunds in any circumstances. 

9. Exclusions and Claims

(a) It is the Customer's responsibility to comply with the terms and conditions specified by the Insurance Companies, their underwriters, and their service vendor/provider concerned. Failing to meet the terms and conditions specified by the Insurance Companies, their underwriters, and their service vendor/provider concerned will expose the Customer to the risks of non-coverage under the Customer's acquired HSPI Insurance.

(b) If the Customer fails to comply with any of the terms and conditions specified by the Insurance Companies, their underwriters, and their service vendor/provider, the Company will not be held responsible or liable to, including but not limited to, any refund of premium paid, either in whole or in part, any claims of benefits under the coverage of the concerned HSPI, etc. hereafter made by the Customer. 

10. Disclaimers and Limitation of Liability

(a) The Company does not and cannot warrant the use of the Company's General Insurance websites will be uninterrupted, error free or virus free.

(b) The Company does not and cannot warrant the accuracy of information, availability and/or quality of products and/or services provided by the Insurance Companies, their underwriters, their service vendor/provider and the delivery service provider.
